What Is an eClosing?

An eClosing is any closing where documents are delivered and executed electronically. If you’re a customer of any Florida Agency Network title agency, you have probably participated in an eClosing as we stay on the cutting edge of closing technology.

If you’re not already one of our lucky time travelers, here’s what an eClosing can look like for you and your customers:

  1. Using our online portal, your customers are not at the mercy of office hours to have documents sent or received. There is no need to fax or come into the office.
  2. Some documents will be sent directly to your customers to be signed electronically. Most modern mortgage documents are signed with services such as Docusign or Adobe Sign.
  3. A digital PDF copy of the Closing Disclosure is sent electronically for review by you and your customers.

Then, most importantly, when it comes to the actual closing day, you and your customers have many choices on where - and HOW - to execute the final documents:

  1. Come to any of our 25+ offices to sit with one of our licensed title agents who can answer any questions you might have. They may have you sign at least some of the  documents electronically.
  2. Next, have your customers meet you at their home, place of work, or your office. We can send one of our "Mobile Closers" to you to make the closing completely convenient and have someone guide your customers through the documents.
  3. With RON, or remote online notarization, you may be able to have your customer close anywhere in the WORLD - while they are on vacation, a work trip, or just sitting on the beach. They just need to be a U.S. citizen and have a strong WiFi connection.

Who can you help with eClosing technology?

For months, your Title Agent has told you about how 2020 is the year of remote online notarization (RON), and we’re proud to be the first title company in Florida to offer completely paperless eClosings! While it’s certainly a cool new way to complete your closing, the real question is – how can WE help YOU help YOUR customers?

We’ve put together a few examples of real world customers that would benefit from our eClosing and RON solutions.

Closings with Multiple Signers

Florida has one of the highest rates of inherited properties, and many times, the children who are inheriting these homes live all over the country or even abroad. This can create confusion and lengthy procedures because, under a typical closing, the title agency must provide a mail-away package or arrange for each person to visit a separate closing room. Now, all parties involved can sign at the same time, regardless of physical location – saving everyone involved time and money!

Sellers Traveling or Stationed Internationally

Traveling or working out of the country is usually planned well in advance, but sometimes, members of the military, those with jobs that call them abroad, or even vacationers can get caught with a closing before they make it back to the States. While there are solutions available for out-of-country sellers, it usually requires finding a notary at a US Embassy/Consulate, and there have been cases where transactions fell through because this wasn’t possible. RON is an excellent solution to help facilitate this and can help make the process that much easier.

Earlier this month, our CEO, Aaron Davis, led a presentation at a conference for licensed title agents at the Gaylord Palms Conference Center in Orlando with the aim of providing resources for title agents to get ahead of the game on upcoming legislation and the changes that will soon sweep the industry.

 

At the conference, attendees enjoyed learning more about the various types of eclosings available. They were also educated on the different types of eClosings, including hybrids, in person, and RON, or Remote Online Notarization, and discussed numerous digital closing topics, such as:

The attending agents were able to earn CE credit as a result of their participation and are now better prepared to transition into the era of eClosings and remote online notarization.

As with most things in life, everything starts with a vision.

“In the world of real estate settlement services, it’s a vision to buy, refinance, and sell a house on a tablet device. No pens. No paper. No rubber-stamped notary seal. No 100’s of pieces of paper to be purchased, printed, signed, shipped and scanned. Oh, and shredded, who can forget shredding? Don’t get me started,” says Aaron M. Davis, CEO of Florida Agency Network (FAN).

For the world of real estate closings, the vision has been for years to transform an industry’s archaic processes through innovation and new technology. Aaron has made FAN’s purpose to innovate and blaze the path for homeownership to become more seamless, paperless, and less cumbersome for the consumer. His passion for revolutionizing the title insurance industry started decades ago, sitting in his mother’s title agency in Plant City, Florida.

“I remember the days of hand balancing HUD statements. Policies in triplicate form. Our first fax machine, our first desktop computers, Novell servers, dial-up modems, and paper. Lots and lots of paper. 200 pieces of paper per file, 30 files per storage box, and lugging boxes of files in and out of storage.”

Settlement has come light years from those days, however one piece has been missing. Remote Online Notarization, or RON for short. The ability to interface remotely via safe, online portal, digitally signing documents, and affixation of the electronic notary seal, all on a tablet device.

Pat Kinsel started Notarize because he had one too many bad notary experiences. In his case, the last straw was a notary agent who forgot to sign his document just before he went on vacation. He didn’t learn of the error until he was gone.  Pat knew “there has to be a better way!”

Developing that better way required a sharp focus on innovating both in the areas of technology and public policy. In researching the process, Pat discovered the Commonwealth of Virginia had passed a law in 2011 to become the first state to allow remote electronic notarization, and all 50 states must recognize Virginia’s ability to transact business in this new way. Building upon these policies, and with cooperation from the Commonwealth of Virginia, Pat and his team have spent the past years developing an amazing product to fundamentally transform the notary process for consumers, businesses, and agents. Technology and policy have converged, and Notarize is bringing notary into the 21st Century.

When Aaron met the team at Notarize in mid-2017 and demoed their product, he knew he had just witnessed the missing piece to the puzzle, and the future of real estate settlement: Paperless, convenient, efficient, and best of all, secure.

Fast forward to today, thanks to a partnership and friendship with Pat Kinsel and Adam Pase of Notarize, FAN could collaborate with a company whose vision and innovative pursuit in the online closing space is revolutionizing the real estate closing process. One final element in the equation came down to the backing from Westcor Land Title Insurance. With Westcor’s support and Notarize’s technology, FAN conducted its first fully-digital, 100% paperless, remote online notarization closing in March 2018.

The vision didn’t stop there. “After completing our first fully-digital purchase transaction using an online notary earlier, we knew the next step would be utilizing the technology for a refinance transaction,” said Aaron.

Hillsborough Title, a proud member of Florida Agency Network, suggested to one of its borrowers, Mr. Gallagher, to close his refinance transaction digitally. During the closing, Mr. Gallagher exclaimed that his digital experience was “very efficient” and “superb.” That was the goal; It’s about providing convenience and ease of use to consumers. “Our borrower was thrilled at the efficiency throughout the entire process. This transaction was a keybreakthrough in providing our clients the option of a fully digital remote closing at the time and location of their choosing,” said Aaron.

As the Chief Operating Officer of Florida Agency Network, Mike LaRosa said, “We were fortunate to have all of the necessary parties willing and able to take this historic step for the Florida title insurance industry. The Notarize platform made the idea of a RON closing experience a legitimate possibility, and the forward thinking of Westcor made it a reality. Finally, combining the right real estate, lending, and title partners allowed for a cooperative experience for Mr. Gallagher, our mutual end-consumer. We were obviously thrilled to be a part of history, and also to be able to offer Mr. Gallagher, and our future clients, this unique experience.”

Everyone working on the transaction couldn’t help but celebrate how convenient it was to close, and how they had just witnessed the future of settlement. There will always be a time and place for physical closings, the coming together of buyers, sellers, real estate agents, and lenders to meet and sign at closing. This gives a great alternative should a party not physically be able to attend.

Tampa, Fla. – April 3, 2018 – Florida Agency Network announced the completion of its first 100 percent paperless, fully-digital real estate refinance transaction with United Wholesale Mortgage and Florida Mortgage Firm. The closing was completed at the office of Florida Mortgage Firm. All closing documents were executed electronically, and the Electronic Notarization of mortgage and affidavits was performed by Notarize via an online interface.

“After completing our first fully-digital purchase transaction using an online notary earlier this month, we knew the next step would be utilizing the technology for a refinance transaction,” said Aaron M. Davis, CEO of Florida Agency Network. “Our borrower was thrilled at the efficiency throughout the entire process. This transaction was a key breakthrough in providing our clients the option of a fully digital remote closing at the time and location of their choosing.”

Hillsborough Title completed the transaction utilizing remote online notarization via Notarize, the first notary public platform allowing any person or business to get their documents legally notarized online, and Westcor Land Title Insurance Company, who underwrote and issued the title insurance policy.

It’s 5:07PM on March 7, 2018.  Shawn Pugh, Paramount Title’s Regional Manager, is seated in the office of Century 21 Beggins on Madeira Beach, FL with Barbara Ferrell, a seller in her 60’s, born and raised Florida, who is selling her St. Pete Beach condo. After completing a series of questions to authenticate Ms. Ferrell’s identity (including examination of her Florida Identification), and reviewing all documents to be signed, the online Virginia notary, Jacqueline Smith, appears on the laptop screen. With the provided information, Jacqueline, the online notary, verifies Barbara’s identification. As an added measure of security, Barbara is asked to scan the room with the web camera to make sure nothing is abnormal. After revealing her surroundings and taking an oath with the online notary, Barbara begins the process of digitally signing documents in the Notarize portal.  History was made as Ms. Ferrell began to sign the FIRST E-Notarized documents in the State of Florida!

Once signing was complete, Ms. Ferrell was informed that she just participated in the very FIRST fully-paperless, fully e-notarized digital closing in the State of Florida. This was a culmination of weeks of effort ensuring that the proper organizations were involved. Florida Agency Network’s leadership, along with their IT provider, Premier Data Services (PDS), completed various tasks before the transaction could be completed, including a thorough test of networks, ensuring wireless capabilities worked properly, and making sure all devices were up-to-date.

Aaron M. Davis, CEO of Florida Agency Network (FAN), was introduced to Notarize.com over a year ago during a title conference. They brainstormed what a fully digital, e-notarized closing would look like, and how to bring online notarization to the State of Florida. Through that process a partnership and friendship with Pat Kinsel and Adam Pase of Notarize developed. Notarize was impressed with the technical capabilities, size, drive, and passion within the FAN organization. FAN was equally impressed with Notarize’s vision and innovative pursuit in the online closing space with revolutionary, one-of-a-kind technology, readily available in the app store. As the final component to the relationship, Westcor announced it would underwrite these transactions, and soon the partnership caught the attention of the lender community. One of the largest non-bank lenders, United Wholesale Mortgage, then became part of the equation.

FAN and Notarize closed the first transaction with a cash deal. During this transaction, parties were guided through the closing with the seller utilizing Notarize, and the buyers utilizing Venture Sign for electronic signatures on all documents. Once the closing was complete, each parties’ closing packages where saved in FAN’s secure portal, Closing Manager. The portal was customized and developed by PDS and offers safe document sharing and storage, secure wire instruction distribution, easy order submission, and full access to all transactions.

“This is a historic transaction, not just for Paramount Title and the Florida Agency Network, but also for the State of Florida and the real estate and settlement industry. We have long dreamed of the day of having a truly paperless closing, including documents requiring notarization. We literally prepared, closed, and recorded an entire transaction digitally, without printing anything on paper. Our goal is to make this an option for all our clients. Not only does it streamline the process, but now reduces our industry’s impact on the environment. Paperless, digital closings offer many advantages versus the slower, traditional paper-based system. The paperless era has officially arrived!" said Aaron M. Davis, CEO of FAN.

Both the buyer’s agent and the listing agent were thrilled to take part in this historic event. The Buyer’s Agent, Lisa Coflin Heisner with RE/MAX All Star said, “Being a part of the first paperless transaction in Florida’s history was truly exciting. As a Realtor, I greatly appreciate such use of digital technology that offers our customers a smooth, convenient, comfortable experience at closing. My buyers were quite pleased with the process.”

The Seller’s Agent echoed the same sentiment; Maria MacNeil of Century 21 Beggins said, “For the busy person, this is going to be a fantastic product.  It will save a lot of time for travel and allow them to close at their home or office.”

“In keeping with the culture of Century 21, and our focus on technology and the consumer experience, it was exciting to be a part of history. Innovation is key to success in the real estate business. As an industry, we must develop a speedier and more efficient closing process. Paramount Title electronically recorded the documents and issued a title policy within 4 hours of closing. After the closing, Barbara Ferrell, the seller said, “I had a great experience! It was a first for me, to do a closing without paper. I enjoyed being a part of it!” In a funny twist, Barbara had miscommunicated with the person designated to drive her home from the closing, so Shawn, our Manager, volunteered to drive her home. Barbara said, “Now that’s the best service I have ever had from a title company!” Shawn laughed, “That’s what we do, go above and beyond. We close electronically and safely deliver our sellers to their home!”
